WARRANTY / TERMS & CONDITIONS

RESIDENTIAL LIMITED 15 YEAR WARRANTY FlakePro Coatings systems are warranted against chipping, peeling, delamination, and UV discoloration for 15 years of the original purchaser. Non-concrete surfaces (including wood joints, steps, and similar materials) are not covered under this warranty. Vertical surfaces are not covered under this warranty. Substrate failure—such as cracks, concrete sinking, or future structural movement—is not covered. Damage caused by corrosion, rust penetration, or exposure to harsh chemicals (including gasoline, brake cleaner, or ammonia) is not covered.

COLORS The Customer is responsible for all color selections. Final colors and their corresponding locations will be noted per project area. Unless otherwise stated, all FlakePro Coatings systems are applied with a gloss finish. Color changes requested after confirmation may cause project delays and are subject to additional charges.

TEXTURE All surfaces can become slippery, especially when wet. FlakePro Coatings provides a non-porous finish, which may allow temporary standing water or condensation. This can create a slip hazard when wet. Surface sweating or condensation may occur when the slab temperature is cooler than the surrounding air. While our coating system adds some insulation, it does not eliminate sweating. It is strongly recommended that a slip-resistant additive be applied to surfaces where slipping may be a concern. Texture options include:

• None: No added texture
• 20–40 grit silica sand: Typically used for exterior areas, sidewalks, and pool decks

FlakePro Coatings assumes no responsibility for injuries caused by slips or falls. The purchaser is solely responsible for maintaining safety for themselves and their guests. Future adjustments to texture or slip resistance are available upon request and may incur additional costs.

SUBSTRATE FAILURE / CRACK REPAIR FlakePro Coatings uses professional-grade repair materials to fill existing cracks and imperfections. However, future movement, settling, or expansion/contraction of the concrete may cause cracks to reappear. The Customer acknowledges that substrate failure (including cracks) is not covered by this warranty.

MOISTURE STOP DISCLAIMER Some projects require special moisture-mitigation treatments determined during initial inspection. If unforeseen moisture is discovered during installation, additional chemical preparation may be required and could result in added costs and/or scheduling delays. Even when moisture-preventative chemicals are applied, FlakePro Coatings does not warrant against: Standing water, sweating or condensation, water intrusion or leaks.

START DATES FlakePro Coatings does not guarantee or imply specific job start or completion dates. Scheduling may vary due to weather, material supply, or unforeseen site conditions.

OBSTRUCTION REMOVAL It is the Customer’s responsibility to remove all obstructions (such as personal items, vehicles, shelving, or stored goods) before the scheduled installation date. FlakePro Coatings is not responsible for moving or removing items. Failure to clear the workspace may result in project delays and additional service charges.

DUST PROTECTION FlakePro Coatings uses high-performance grinders and industrial vacuum systems designed to minimize airborne dust. However, some dust may still escape into adjacent areas. Customers are responsible for covering or removing nearby items (e.g., wall art, electronics, cabinetry, shelving, etc.) prior to installation.

STANDING WATER / CONDENSATION / WATER INTRUSION / RUST STAINS Issues related to standing water, condensation, leaks, water intrusion, or rust staining are not covered under any warranty provided by FlakePro Coatings.

SURFACE IMPERFECTIONS FlakePro Coatings will make every effort to properly prepare the surface before installation. However, coatings do not level or grade the concrete. Existing surface imperfections (such as low spots or minor high areas) may remain visible and could result in standing water. No guarantee—expressed or implied—is made that all surface imperfections will be hidden by the coating process.

VERTICAL COATING Coatings applied to vertical surfaces are decorative only and not covered under this warranty. FlakePro Coatings does not sand, grind, fill, or repair vertical areas. Pre-existing flaws may remain visible, and vertical surfaces may differ in appearance from horizontal ones. Some textures may feel rough or sharp to the touch; use caution when handling coated vertical surfaces.

RETURN TO USE Drying and curing times may vary due to temperature, humidity, and other conditions. Unless stated otherwise:

• 12 hours after completion: Light foot traffic is permitted
• 24 hours after completion: Lightweight items (boxes, décor) may be returned to the area
• 48 hours after completion: Full use permitted (vehicles, heavy items, tools, appliances)

FlakePro Coatings is not responsible for any damage caused by premature use of the surface before the recommended cure times.

CANCELLATION The Buyer may cancel this contract within three (3) business days of signing without penalty. After this period, the down payment is nonrefundable. Cancellations must be made in writing and sent to: FlakePro Coatings, 1270 Indiantown Rd, Stevens PA, 17578. If materials are ordered or delivered before cancellation, and the Buyer does not make them available for pickup within 20 days, the Buyer remains responsible for any related costs.

LIENS / SECURITY INTEREST Under state law, FlakePro Coatings reserves the right to file a mechanic’s lien on the property for any unpaid balance, including statutory interest and attorney’s fees.

LATE PAYMENTS / LEGAL ACTIONS Payment is due upon completion of work unless otherwise agreed in writing. Interest on unpaid balances will accrue at 2% per month (24% annually). If legal action is required to collect payment, the Customer agrees to pay all reasonable attorney’s fees, court costs, and accrued interest at 2% per month from the judgment date.

ARBITRATION OF DISPUTES Any dispute, claim, or controversy (“Claim”) arising from this Agreement shall be resolved through binding arbitration under the Commercial Rules of the American Arbitration Association (AAA). Arbitration will take place in the judicial district where FlakePro Coatings’ corporate office is located. Both parties waive their right to jury trial or class action participation. Arbitration findings are final and may include awards for costs and legal fees. Either party may seek judicial relief to enforce a monetary obligation, lien, or judgment without waiving the right to arbitration for other disputes. All arbitration proceedings shall remain confidential.

FINAL WARRANTY CLAUSE Entire Agreement and Limitation of Warranty. The Buyer acknowledges receipt of this Warranty and agrees that it constitutes the full and final agreement between the parties regarding the product warranty. No verbal statements, promises, or representations not expressly included herein shall be binding on either party. This warranty is provided solely by FlakePro Coatings and shall remain valid only while FlakePro Coatings is in operation. In the event that FlakePro Coatings ceases to conduct business or is dissolved, this warranty shall automatically terminate and become null and void, and no further claims shall be accepted or honored.
